Permanent disability partially compensates an injured worker for the residual handicap, helping him/her return to the labor market. These payments are to start within 14 days of the last temporary disability payment and continue until a reasonable estimate is paid. Late payments are to be increased by 10%.
Permanent disability weekly payments are paid at 2/3 of weekly earnings--not to exceed the maximum rate. For injuries after 1/1/06; 1% to 69.75% this is paid at $230 per week. For disabilities 70% to 99.75% this is paid at the rate of $270 per week.
Permanent disability is not increased by the State Average Weekly Wages or Cost of Living Increase per Labor Code 4453 (b).
If your employer has 50 or more employees and you are not offered a modified job, the permanent disability is increased by 15% commencing 60 days after you have reached maximum medical improvement. If you ARE offered a job, then the permanent disability is decreased by 15%, even if the employer has less than 50 employees.
